1. Who we are (Seller)

The Seller operates as an individual under "unregistered activity" (dzialalnosc nierejestrowana) pursuant to Article 5 of the Polish Entrepreneurs' Law. This means the Seller is a natural person not running a registered business.
2. Definitions
2.1. "User" means any person using the Service.
2.2. "Digital Content" means the audio guides made available through the Service (streaming access).
2.3. "Package" means unlimited access to a set of Digital Content for a specific city and language.
2.4. "Single POI" means unlimited access to one selected point-of-interest audio file.
2.5. "Consumer" means a natural person acting for purposes outside their trade, business, craft or profession (EU definition).
3. What Beavly provides
3.1. Beavly provides web-based, on-demand access to Digital Content (audio guides) that can be played directly in the browser.
3.2. No app installation or user account is required.
3.3. Access is granted indefinitely on the same device and browser.
4. AI-generated materials (important notice)
4.1. Some or all Digital Content and/or parts of the Service content may be created or assisted by artificial intelligence (AI).
4.2. While we strive for accuracy and quality, AI-assisted materials may contain mistakes or simplifications. The content is provided for informational and entertainment purposes and does not constitute professional advice.
4.3. If you notice a factual error or an issue affecting your experience, please contact us at support@beavly.eu.
5. Languages and access rules
5.1. Packages are language-specific. A Package purchased for one language grants access only to Digital Content in that language.
5.2. You may purchase Packages in multiple languages. Each language access is valid indefinitely on the same device.
5.3. Single POI purchases grant access to the specific audio file purchased (independent of any Package).
6. Technical requirements
6.1. To use the Service, you need a compatible device (smartphone/tablet/computer), a modern web browser, headphones/speakers, and an internet connection.
6.2. The Service works online; offline playback is not guaranteed.
7. Prices, payments, and invoices
7.1. Prices are displayed before purchase and may differ by currency/language. The total price is shown before you confirm payment.
7.2. Payments are processed by Stripe (Stripe Checkout). We do not store full payment card data.
7.3. The Stripe payment confirmation (e.g., email from Stripe or transaction history) serves as proof of purchase. As a rule, we do not automatically issue invoices or receipts. If you need a document confirming the sale, or if applicable law requires such a document in your situation, please contact us at support@beavly.eu within 3 months from the date of purchase.
8. Granting access and delivery of Digital Content
8.1. After successful payment, access is granted electronically and should become available shortly after returning from the payment page.
8.2. If access is not granted, please contact support@beavly.eu and include the email used for payment and (if available) the Stripe session/confirmation details.
9. Right of withdrawal (EU consumers)
9.1. If you are a Consumer in the EU/EEA/UK, you generally have a 14-day right to withdraw from distance contracts.
9.2. IMPORTANT: For Digital Content not supplied on a tangible medium, the right of withdrawal may be lost once performance has begun with your prior express consent and acknowledgement.
9.3. By purchasing access that is delivered immediately after payment, you agree that the performance begins immediately and you acknowledge that you may lose your right of withdrawal once access is granted.
9.4. If you believe a refund is due (e.g., double charge, technical failure on our side), contact support@beavly.eu. We handle issues fairly and case-by-case.
10. Prohibited use
10.1. You may not copy, redistribute, resell, publicly broadcast, record, or otherwise exploit the Digital Content beyond personal use.
10.2. You may not attempt to bypass access controls, reverse engineer, scrape, or interfere with the Service.
11. Intellectual property
11.1. All rights to the Service, website design, and Digital Content (including AI-assisted materials) remain with the Seller or its licensors.
11.2. You receive a limited, non-exclusive, non-transferable right to access and listen to the Digital Content for personal use.
12. Complaints and support
12.1. Complaints can be submitted to support@beavly.eu.
12.2. Provide a description of the problem, date/time, device/browser, and payment email to help us resolve the issue quickly.
12.3. We aim to respond within a reasonable time.
13. Liability
13.1. The Service is provided "as is" and "as available". We will make reasonable efforts to keep it operational.
13.2. To the extent permitted by law, we are not liable for interruptions caused by factors outside our control (e.g., internet connectivity, device limitations, Stripe downtime).
13.3. Nothing in these Terms limits liability where such limitation is not permitted by applicable law.
14. Changes to these Terms
14.1. We may update these Terms from time to time. The "Last updated" date will be changed accordingly.
14.2. Changes apply prospectively. Purchases already made remain governed by the version in force at the time of purchase, unless the law requires otherwise.
15. Governing law and dispute resolution
15.1. These Terms are governed by the laws of Poland, without prejudice to mandatory consumer protection laws in your country of residence.
